DISCLAIMER OF LIABILITY AND ASSUMPTION OF RISKS

WARNING: PLEASE READ THIS DOCUMENT CAREFULLY. Bungee jumping is an activity that carries serious risks, including injury or death. By signing this document, you accept these risks and waive any legal claims against Montréal Bungee.

1. RISKS INHERENT IN THE ACTIVITY

I acknowledge that I have been informed of the risks associated with bungee jumping, including:

  • Physical injuries, including those due to falls or movements such as fractures, strains, bruises, neck problems, spinal injury, concussion, nerve damage, ophthalmological risks.
  • Activity-related stress disorders, such as dizziness, lightheadedness, hyperventilation or palpitations, post-traumatic stress disorder and phobias.
  • Weather conditions, such as heatstroke or sunstroke.

I understand that these risks are inherent to the activity and that they cannot be completely eliminated despite the security measures in place.

2. CONDITIONS OF PARTICIPATION

I confirm :

  • Not being pregnant.
  • Not suffer from serious medical conditions, including heart problems, respiratory problems, or other conditions incompatible with the activity. In particular, back and spinal problems, neurological conditions (including head injuries or concussions), and psychiatric disorders.
  • Adhere to specified weight limits (100-250 lbs).
  • Not having received medical advice advising against bungee jumping or participation in extreme sporting activities.

NOTE: It is strongly recommended to consult a doctor before bungee jumping.

I agree to provide accurate information regarding my health and to report any factors that may compromise my safety or that of other participants. Montréal Bungee reserves the right to exclude any participant deemed unfit.

3. ACCEPTANCE OF RISKS AND PREVENTIVE COMMITMENT

I agree to adopt a precautionary and prudent attitude during the activity to ensure my safety and that of others. I acknowledge that I am participating voluntarily and fully accept the associated risks.

4. DISCLAIMER OF LIABILITY

I release and discharge Montréal Bungee, its employees, partners, and agents from any liability for any injury, death, loss, property damage, or other damages or causes of action of any kind, incurred before, during, or after the activity, including negligence, except in cases of willful misconduct or gross negligence. I acknowledge that this release of liability applies to my heirs, successors, assigns, executors, or legal representatives.

5. REFUND POLICY

I understand that:

  • Activities are non-refundable except in the event of cancellation by Montréal Bungee.
  • Videos or photos not provided only entitle you to a refund of that part of the package.

6. SAFETY INSTRUCTIONS AND BEHAVIOUR

I undertake to comply with all safety instructions, including:

  • Do not participate under the influence of drugs or alcohol.
  • Do not use a phone or camera during the activity, unless prior authorization is given.
  • Follow the instructions given by Montreal Bungee staff.

Any violation may result in immediate exclusion without refund.

7. Right to image

By participating in any of our activities, events or services, you agree that photos, videos or other audiovisual recordings may be taken by our staff or authorized persons.

These images may include portraits, action scenes, or general shots where you may be identifiable. They may be used, without financial compensation, for promotional, communication, marketing, or archival purposes, including but not limited to:

  • Our website
  • Our social networks
  • Our brochures, posters or any other communication media
  • Publications in partner media

By agreeing to participate in our activities, you expressly consent to assign, free of charge, your image rights as specified above. This consent is given without limitation of duration or territory.

If you do not wish to appear in the images, it is your responsibility to inform us before the start of the activity. We will then do our best to respect your choice.
